Currently Kentucky has not passed legislation for Clean Slate policies, but has passed related legislation.

KRS 431.076 was enacted July 2020.
- All criminal charges on a case that is dismissed with prejudice or not in exchange for a guilty plea to another charge, are automatically expunged (does not require the individual to file a petition or pay money).
Records in Kentucky are expunged (not deleted).
- Expunged court records can only be accessed by court personnel with a court order.
- Expunged criminal history records can be accessed/seen only by limited (fewer than 10) repository staff for audit purposes.
- Current expungement statute definition of “expungement” is: that records do not appear on any state-performed background checks.
